These Terms of Service ("Terms") govern your use of 3D User at 3duser.org ("3D User", "we", "us", "our", or the "Site").

By creating an account or using 3D User, you agree to these Terms. If you do not agree to them, you must not use the Site.

You must be at least 16 years old to create an account or use 3D User.

By creating an account or using the Site, you confirm that you meet this requirement.

You are responsible for:

• keeping your login credentials secure;
• activity carried out through your account; and
• providing reasonably accurate account information.

You must not allow another person to use your account to evade restrictions, suspensions or bans.

We may restrict, suspend or terminate accounts that violate these Terms.

You must not use 3D User to:

• harass, threaten, abuse or deliberately intimidate another user;
• post or distribute illegal content;
• post spam or malicious content;
• infringe another person's intellectual property, privacy or other legal rights;
• impersonate another person in a manner intended to deceive;
• use bots, scripts, chess engines or other automated assistance when playing chess against another human user;
• bypass or attempt to bypass a suspension, ban, access restriction or security measure;
• scrape or systematically collect information from the Site without permission;
• attempt to gain unauthorised access to accounts, servers, world servers or other systems;
• introduce malware or otherwise interfere with the security or normal operation of the Site; or
• use the Site for unlawful purposes.

Using 3D User's built-in AI chess opponents is permitted.

You retain ownership of original content you create and post on 3D User.

This may include forum posts, replies, comments, profile information and other original material you contribute.

By submitting content to 3D User, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and distribute that content to the extent reasonably necessary to operate and provide the Site.

For example, this licence allows us to store a forum post and display it to other users.

This licence does not transfer ownership of your original content to us.

Information generated as part of operating the service, such as account records, gameplay records, moderation records and aggregate service statistics, may be stored and used by us to operate, maintain, secure and improve 3D User in accordance with our Privacy Policy.

3D User allows users to enter 3D worlds that may be operated by other users on independently controlled world servers.

World owners are responsible for the operation and content of their worlds, subject to these Terms and any rules or technical restrictions imposed by 3D User.

You must not use a world you operate to:

• circumvent these Terms;
• unlawfully collect or misuse information about visitors;
• distribute illegal or infringing content;
• interfere with 3D User or other world servers; or
• facilitate activity prohibited elsewhere in these Terms.

Access to a particular world may be restricted or withdrawn by its owner or by 3D User where necessary.

Information exchanged with independently operated world servers is described in our Privacy Policy.

You are responsible for content you create, upload or place within a 3D world.

You must have the necessary rights to use any models, textures, images, audio or other material you upload or distribute through 3D User or a world operated through the service.

Ownership of a world, land, building permissions or virtual objects does not give you ownership of 3D User's software, systems or underlying technology.

World owners may establish additional rules for their worlds, provided those rules do not conflict with these Terms.

Some 3D User services require payment, including paid user access and world-server services.

Prices and the applicable subscription period are shown before purchase.

Payments are processed through Stripe.

Unless otherwise stated at the time of purchase, paid access is provided for the period purchased and must be renewed to continue beyond that period.

You are responsible for ensuring that information supplied when making a purchase is accurate.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under applicable Australian law.

If you violate these Terms, we may take action including:

• removing or restricting content;
• limiting access to particular features or worlds;
• issuing a warning;
• temporarily suspending your account; or
• permanently terminating access in serious or repeated cases.

The action taken will depend on the nature and severity of the violation and any relevant previous violations.

Where reasonably practical, we will tell you what action has been taken and why.

We may take immediate action where we reasonably believe it is necessary to protect users, the Site, world servers or other systems.

We aim to keep 3D User available and functioning reliably, but we do not guarantee uninterrupted or error-free operation.

Features may be added, changed, suspended or removed as the service develops.

We may also temporarily restrict access where reasonably necessary for maintenance, security, technical problems or circumstances outside our control.

3D User is provided on an "as available" basis.

To the extent permitted by law, we do not guarantee that the Site will always be available, free from errors, or suitable for every particular purpose.

You are responsible for how you use the Site and for maintaining appropriate copies or backups of content that is important to you.

To the extent permitted by law, we are not responsible for loss or damage caused by:

• circumstances outside our reasonable control;
• the actions or content of other users;
• independently operated world servers;
• unauthorised use of your account resulting from your failure to keep your credentials secure; or
• reliance on AI-generated content.

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded under Australian law.

You may stop using 3D User and request deletion of your account at any time.

We may suspend or terminate access where an account seriously or repeatedly violates these Terms, presents a security risk, or is being used unlawfully.

What happens to your information and previously published content when an account is deleted is explained in our Privacy Policy.

Our Privacy Policy explains what personal information we collect, how it is used, how long it is retained, and what information may be provided to independently operated world servers.

Use of 3D User is subject to that Privacy Policy.

We may update these Terms when the service, our practices or legal requirements change.

If we make a meaningful change, we will update the "Last updated" date above.

Your continued use of 3D User after updated Terms take effect constitutes acceptance of those Terms.

These Terms are governed by the laws of Western Australia, Australia.

You and 3D User submit to the jurisdiction of the courts of Western Australia and any courts entitled to hear appeals from them.

Nothing in this section limits any rights you may have under applicable consumer law.
